Changes are published on this page; the version applicable at the time of ordering governs that order (full version history is documented). ARTICLE 2 — DEFINITIONS 1. "BL4CKOUT": the supplier of products through bl4ckout.nl. 2. "Consumer": the natural person not acting in a professional or commercial capacity. 3. "Agreement": the sales agreement between BL4CKOUT and the consumer. ARTICLE 3 — APPLICABILITY 1. These terms apply to every offer and agreement concluded through the website. 2. Deviating terms are only valid if agreed in writing and never to the consumer's disadvantage where they affect mandatory law. ARTICLE 4 — THE OFFER 1. Every offer on the website is without obligation; obvious errors and mistakes do not bind BL4CKOUT. 2. Product images are indicative; minor deviations in colour and measurements do not entitle the consumer to rescission, in line with Dutch Civil Code art. 7:17. 3. Prices are in euros, including VAT and excluding shipping. Shipping costs are clearly stated before completing the order. For "was/now" prices, the reference price is the lowest price in the preceding 30 days, in accordance with the EU Omnibus Directive. ARTICLE 5 — THE AGREEMENT 1. The agreement is concluded when BL4CKOUT confirms the order by e-mail. 2. BL4CKOUT may refuse an order or rescind the agreement for justified reasons such as obvious errors, suspected fraud, or unavailability. Any amount already paid is refunded within 14 days. ARTICLE 6 — DELIVERY 1. Delivery takes place within 30 days of conclusion of the agreement, unless otherwise agreed. In practice BL4CKOUT usually delivers within the Netherlands in 1-5 business days. 2. In case of foreseeable delay, the consumer is notified no later than 5 days after detection, with a new delivery term and the right to rescind free of charge. 3. Risk of loss or damage passes to the consumer upon delivery to the consumer or an appointed representative. ARTICLE 7 — RIGHT OF WITHDRAWAL Full text, exceptions and the model withdrawal form: see the "Return policy & right of withdrawal" page (also annexed to these terms). The electronic withdrawal function (withdrawal button) is available at https://bl4ckout.nl/en/returns and requires no account. ARTICLE 8 — PAYMENT 1. The consumer may pay using the payment methods offered on the website (including credit card, iDEAL, Klarna). 2. Payment details are securely processed by our payment provider (Stripe); BL4CKOUT never stores full card data. 3. In case of late payment, BL4CKOUT may claim statutory interest and reasonable collection costs. ARTICLE 9 — STATUTORY WARRANTY AND CONFORMITY 1. Products delivered by BL4CKOUT conform to the agreement and to the consumer's reasonable expectations (Dutch Civil Code art. 7:17). 2. In case of non-conformity, the consumer has the statutory rights to repair, replacement or rescission, and may rely on the presumption of defects for two years after delivery (art. 7:18 et seq.). 3. Any commercial guarantee (e.g. "30-day returns") supplements and never limits these statutory rights. 4. Warranty claims: via the withdrawal button (choose "Warranty claim") or by e-mail. For justified claims, return costs are borne by BL4CKOUT. ARTICLE 10 — COMPLAINTS 1. Complaints can be filed via the contact form (https://bl4ckout.nl/en/support), the withdrawal button, or by e-mail. 2. Complaints are acknowledged within 24 hours and substantively answered within 14 days; for complex complaints the consumer is informed within that term with an indicative resolution period. 3. The consumer may approach the Thuiswinkel Disputes Committee (thuiswinkel.org) or the Dutch Authority for Consumers and Markets (ACM). The EU ODR platform (ec.europa.eu/consumers/odr) is available for cross-border disputes. ARTICLE 11 — LIABILITY 1. BL4CKOUT is liable only for direct damage that is the direct result of an attributable failure by BL4CKOUT, up to the invoice amount of the relevant order. 2. This limitation does not apply in case of intent or gross negligence, nor where mandatory law provides otherwise (including personal injury). ARTICLE 12 — INTELLECTUAL PROPERTY All rights to the website's content (brands, texts, imagery, design) belong to BL4CKOUT or its licensors. Reproduction without written consent is prohibited. ARTICLE 13 — GOVERNING LAW AND JURISDICTION 1. Dutch law applies to all agreements. 2. Disputes are submitted to the competent court in the district of the consumer's place of residence, without prejudice to the consumer's right to choose the court of BL4CKOUT's place of business.
